  A meeting of the Swarthmore Borough Council was called to order on Monday, December 21, 2009 at 7:30 p.m. Present were, President Huestis, Vice-President Smythe, Mr. Jacobs, Mr. Jefferson, Ms. Knapp, Ms. Lewicki and Ms. Parker. Ms. Jane Billings, Borough Manager, and Mr. Robert Scott, Borough Solicitor, were also present.

PUBLIC HEARING ON PROPOSED ORDINANCE AMENDING THE BOROUGH ZONING CODE RELATING TO THE REGULATION OF BILLBOARDS:

There were no comments from the public.

PUBLIC COMMENT:

Mr. Rick Lee, Vice-President of the Swarthmore Fire & Protective Association, announced that Christmas trees will continue to be sold up through the Christmas holiday. He also thanked outgoing Borough Council members.

Mr. Brian Craig, along with members of the Swarthmore Police Department, presented outgoing mayor Eck Gerner with a photo collage, plaque and a jacket.

Mr. Edmund Jones, of 227 Haverford Avenue, praised Mayor Gerner for gaining recognition for Swarthmore in the magazine Main Line Today.

Mr. David Grove of 80 Yale Avenue thanked Mr. Huestis, Ms. Parker and Mayor Gerner for their service to the Borough Council.

Mr. Stu Hain of Swarthmore College thanked Mayor Gerner for his service, noting in particular his efforts in to bring the college closer to the Swarthmore community.

PRESIDENT:

Upon a request from Mr. Huestis, Ms. Parker’s motion to approve the Council Meeting minutes of November 9, 2009 and the Work Session minutes of December 7, 2009 was seconded by Mr. Jacobs and passed unanimously by Borough Council.

Upon request from Mr. Huestis, Ms. Knapp’s motion to approve the 2010 Council Meeting Schedule was seconded by Ms. Smythe and passed unanimously by Borough Council.

Upon request from Mr. Huestis, Ms. Smythe’s motion to approve the 2010 Holiday Schedule was seconded by Mr. Jefferson and passed unanimously by Borough Council.

FINANCE AND COMMUNITY DEVELOPMENT:

Mr. Jefferson’s motion to approve the Financial Report for November was seconded by Ms. Parker and passed unanimously by Borough Council.

Mr. Jefferson’s motion to approve the Bills to Pay in the amount of $126,671.20 was seconded by Ms. Lewicki and passed unanimously by Borough Council.

Mr. Jefferson’s motion to approve the Checks to Ratify in the amount of $5,032.60 was seconded by Ms. Parker and passed unanimously by Borough Council.

Mr. Jefferson’s motion to adopt the 2010 Operating and Capital Budget was seconded by Ms. Parker and passed unanimously by Borough Council.

Mr. Jefferson’s motion to adopt the following ordinances and resolutions was seconded by Ms. Smythe and passed unanimously by Borough Council:

• Ordinance 1029, Tax & Fee Ordinance
• Resolution No. 2009-09, Fees and Charges
• Resolution No. 2009-10, Employee Contributions to Police Pension Plan
• Resolution No. 2009-11, Employee Contributions to the Non-Uniformed Pension Plan
• Resolution No. 2009-12, Setting Cost-of-Living Increase for Borough Pensioners
• Resolution No. 2009-13, Appointing the Borough Auditor for 2010
• Resolution No. 2009-14, Authorization for Borough Tax Collector to Collect the Annual Sanitary Sewer Usage Fees

ENVIRONMENT: No report.

GOVERNMENT:

Ms. Smythe’s motion to approve Ordinance No. 1030, amending eligibility requirements for the Borough of Swarthmore Non-Uniformed Pension Plan, was seconded by Ms. Knapp and passed unanimously by Borough Council.

PLANNING & ZONING:

Ms. Knapp’s motion to adopt Ordinance No. 1031, amending the Borough’s sign regulations relating to billboards, was seconded by Mr. Jacobs and passed unanimously by Borough Council.

PUBLIC SAFETY: No report.

PUBLIC WORKS, PARKS AND RECREATION:

Ms. Parker thanked the Public Works crew for their service to the community.

Ms. Parker’s motion to adopt Resolution No. 2009-15, adopting the 2010 Residential Recycling Regulations, was seconded by Ms. Lewicki and passed unanimously by Borough Council.

MAYOR:

Mayor Gerner read farewell salutes to Ms. Parker and Mr. Huestis to honor their years of service to Borough Council. He also thanked the Borough community for the opportunity to serve as Mayor.

Mr. Huestis thanked retiring employee Carol Savery for her years of service to the Borough, and also thanked Town Center Coordinator Marty Spiegel for his service as he moves to employment with Swarthmore Town Center, Inc.

Mr. Huestis thanked the community for the opportunity to serve on Borough Council for the last 8 years, and thanked Borough staff for their leadership and service.

MANAGER REPORT:

Ms. Billings expressed thanks to the outgoing staff and Council members.

SOLICITOR:

Mr. Scott reviewed the terms of a proposed new contract with the Delaware County SPCA, and recommended that Council approve the document. Ms. Smythe’s motion to execute the 2010 Stray Animal Boarding Contract with the Delaware County SPCA was seconded by Ms. Parker and passed unanimously by Borough Council.

ADJOURNMENT:

There being no further business, Mr. Huestis’ motion to adjourn the meeting at 9:00 p.m. was seconded by Ms. Parker and passed unanimously by Borough Council.
